A. Arrested or released on summons
B. If arrested, go before the Magistrate - can be released on bail, which may include recognizance, to a person or organization, to a pretrial services agency (see D), to unsecured bond, or to a secured bond; can be incarcerated pending trial. Go to C.
C. Appear at arraignment. Judge will review bond and can release on bail - which may include release to recognizance, to a person or organization, to a pretrial services agency (see D ), to unsecured bond, or to a secured bond, or remain incarcerated pending trial. Waive right to attorney, and have set trial date set. If felony, go to E. If misdemeanor, go to F.
D. Once released to pretrial supervision, must report to the pretrial services officer. If charged with a felony, must report at least once per week. If charged with a misdemeanor, must report at least once every two weeks. Go to E.
E. Appear for preliminary hearing. If probable cause found, case is certified to the grand jury. The grand jury will review the evidence and, if probable cause is found, return a true bill and set a date for appearance before the Circuit Court. Go to F.
F. Appear for trial; judgment entered. If found not guilty, released. If found guilty, go to G.
G. Appear for sentencing hearing. Pretrial supervision ends.
